Terms & Conditions

These Terms & Conditions ("Terms") govern your use of Freelancer Spot ("Platform"), operated by Freelancer Spot ("Company", "we", "us"). By registering or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Eligibility

  • You must be at least 18 years old to use the Platform.
  • By registering, you confirm you have the legal capacity to enter into a binding contract under Indian law.
  • The Platform is primarily intended for users in India. International users may access the Platform but are responsible for compliance with their local laws.
  • Businesses may register by providing valid GST / company registration details where required.

2. Account Registration

  • You must provide accurate and complete information at registration and keep it up to date.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You may not share your account, create multiple accounts, or impersonate another person.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Platform Roles

3.1 Freelancers

  • May create gigs, respond to job postings, receive orders, and withdraw earnings to their wallet.
  • Are responsible for delivering work as described in their gig within the agreed deadline.
  • Must not misrepresent their skills, experience, or portfolio.
  • Are independent contractors — not employees of Freelancer Spot.

3.2 Clients

  • May browse gigs, place orders, post jobs, and release payment upon satisfaction.
  • Must provide accurate project requirements and respond to freelancer communications promptly.
  • Must not request services that violate these Terms or applicable law.

4. Orders & Payments

  • All payments are processed through Cashfree and held in escrow until the order is completed or cancelled.
  • Funds are released to the freelancer's wallet only after the client accepts the delivery or the auto-complete timer (3 days after delivery) expires.
  • A platform fee of 10% is deducted from the order amount before crediting the freelancer's wallet. This fee covers payment processing, platform maintenance, and dispute support.
  • The platform fee is non-refundable once an order is completed.
  • Prices listed on gigs are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.

5. Cancellations & Refunds

Please refer to our Refund Policy for full details. In summary:

  • Orders cancelled before the freelancer accepts them receive a full refund.
  • Orders cancelled after work has started require mutual agreement or admin resolution.
  • Refunds are credited to the client's Freelancer Spot wallet.

6. Intellectual Property

  • Upon full payment and order completion, the client receives all IP rights to the delivered work unless the gig listing specifies otherwise (e.g., licensed use only).
  • Freelancers retain the right to display completed work in their portfolio unless the client explicitly requests confidentiality.
  • Freelancers must not submit work that infringes third-party IP rights.
  • The Freelancer Spot name, logo, and Platform content remain the exclusive property of the Company.

7. Prohibited Conduct

You agree not to:

  • Use the Platform for illegal activities, including money laundering or fraud.
  • Solicit or accept payments outside the Platform to circumvent fees.
  • Post false, misleading, or offensive content.
  • Harass, threaten, or abuse other users.
  • Submit fake reviews or manipulate rating systems.
  • Use automated tools (bots, scrapers) to access the Platform without prior written consent.
  • Reverse-engineer or copy any part of the Platform's software.
  • Create accounts for the purpose of spamming or promoting competing platforms.

Violation may result in immediate account suspension and legal action.

8. Disputes

If a dispute arises between a client and freelancer, either party may raise a dispute through the Platform. Our admin team will review the case and issue a binding decision within 3–5 business days. See our Dispute Resolution Policy for the full process.

9. Wallet & Withdrawals

  • Earnings are credited to your Freelancer Spot wallet and can be withdrawn to a verified Indian bank account or UPI ID.
  • A minimum withdrawal amount may apply (displayed in your wallet dashboard).
  • Withdrawals are processed within 3–5 business days.
  • We reserve the right to place a hold on wallet funds if we suspect fraud or a chargeback is in progress.

10. Subscriptions

  • Some gigs offer recurring subscription billing (weekly, monthly, or quarterly).
  • Clients are responsible for ensuring timely payment on the billing date.
  • Subscriptions paused due to missed payments can be reactivated after payment is made.

11. Limitation of Liability

To the maximum extent permitted by Indian law, Freelancer Spot shall not be liable for:

  • Indirect, incidental, or consequential damages arising from use of the Platform.
  • Quality, accuracy, or legality of services provided by freelancers.
  • Losses caused by unauthorised access to your account due to your failure to keep credentials secure.
  • Service interruptions, data loss, or technical failures beyond our reasonable control.

Our total liability to any user for any claim shall not exceed the total amount paid by that user on the Platform in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Freelancer Spot and its officers, employees, and agents from any claims, losses, or damages arising from your violation of these Terms, misuse of the Platform, or infringement of any third-party rights.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tamil Nadu, India. We encourage users to first attempt resolution through our dispute process before pursuing legal action.

14. Changes to Terms

We may update these Terms from time to time. You will be notified at least 7 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance.
