Freelancer Spot ("we", "us", or "our") operates the platform at freelancerspot.in. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal data when you use our platform. By using Freelancer Spot, you agree to the practices described in this policy.

This policy is compliant with India's Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable Rules thereunder.

1. Data We Collect

1.1 Information You Provide

  • Account data: Name, email address, password (hashed), phone number, profile photo, and bio.
  • Professional data: Skills, portfolio items, certificates, work experience, and education details you add to your profile.
  • Identity verification: Aadhaar/PAN documents submitted for verified badge (stored encrypted; not shared).
  • Payment data: Bank account / UPI details for withdrawals. Card details are never stored by us — they are handled directly by Cashfree.
  • Communications: Messages, order notes, dispute descriptions, and support requests sent through our platform.

1.2 Information Collected Automatically

  • IP address, browser type, device type, and operating system.
  • Pages visited, features used, and time spent on the platform.
  • Cookies and similar tracking technologies (see our Cookie Policy).
  • Push notification tokens for in-app alerts.

1.3 Information from Third Parties

  • Cashfree: Payment status, order IDs, and transaction references.
  • Twilio (via Supabase): Phone OTP verification results.
  • Supabase Auth: Login session data for authentication.

2. How We Use Your Data

  • To create and manage your account.
  • To facilitate transactions between clients and freelancers.
  • To process payments and wallet credits through Cashfree.
  • To send transactional emails (order confirmations, payment receipts, delivery notifications).
  • To send platform notifications and weekly digests (you can opt out anytime).
  • To verify identity and prevent fraud.
  • To improve our platform, fix bugs, and personalise your experience.
  • To comply with legal obligations under Indian law.

We do not sell your personal data to third parties.

3. Data Sharing

We share your data only in the following limited circumstances:

  • Other users: Your public profile, gigs, reviews, and portfolio are visible to all users. Your contact details are never shared without consent.
  • Service providers: Cashfree (payments), Resend (transactional email), Twilio (OTP via Supabase), Vercel (hosting), and Supabase (database). Each provider is bound by data processing agreements.
  • Legal requirements: When required by a court order, government authority, or applicable law in India.
  • Business transfer: In the event of a merger, acquisition, or asset sale, your data may be transferred with prior notice.

4. Data Retention

  • Active accounts: data retained for the lifetime of your account plus 3 years.
  • Deleted accounts: personal data anonymised within 30 days of deletion request; transaction records retained for 7 years as required by Indian accounting law.
  • Wallet and payment records: retained for 7 years (financial compliance).

5. Your Rights (DPDP Act 2023)

  • Right to access: Request a copy of the personal data we hold about you.
  • Right to correction: Ask us to correct inaccurate data.
  • Right to erasure: Request deletion of your account and personal data.
  • Right to grievance redressal: Contact our Grievance Officer (details below) to raise complaints.
  • Right to nominate: Nominate someone to exercise your data rights in case of your death or incapacity.

6. Data Security

  • All data is encrypted in transit (TLS 1.2+) and at rest.
  • Passwords are hashed using bcrypt and never stored in plain text.
  • Database access is restricted by Row-Level Security (RLS) policies.
  • Payment credentials are handled exclusively by Cashfree (PCI-DSS compliant).
  • We conduct regular security reviews and promptly address vulnerabilities.

Despite these measures, no internet transmission is 100% secure. Please use a strong, unique password and enable any available security features on your account.

7. Children's Privacy

Freelancer Spot is not intended for individuals under 18 years of age. We do not knowingly collect personal data from minors. If you believe a minor has registered, please contact us immediately.

8. International Transfers

Our servers and service providers may be located outside India (e.g., Vercel and Supabase infrastructure). Any such transfer is carried out with appropriate contractual safeguards in compliance with the DPDP Act.

9. Changes to This Policy

We may update this policy from time to time. We will notify registered users by email and display a notice on the platform at least 7 days before any material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated policy.
